The Mobility Package is changing the game for JC 140

Since 2022, the European Mobility Package has tightened obligations: mandatory driver return, cabotage rules, prior IMI declaration. On top comes tachograph compliance (2nd-generation digital) and driving-time traceability. SIRS/SIOD and FPS Mobility inspect jointly.

5 key obligations

  1. 2nd-generation digital tachograph

    Mandatory on all vehicles > 3.5t in international transport. Driver data download ≤ 28 days, vehicle ≤ 90 days.

  2. Prior IMI posting declaration

    Every cabotage or international transport operation = prior IMI declaration. Minimum 6 months retention.

  3. Driving time & rest compliance

    EC Regulation 561/2006: max 9h/day, 56h/week, weekly rest ≥ 45h every 2 weeks.

  4. CMR consignment note + accompanying document

    Any international transport = CMR mandatory on board. 2-year retention after delivery.

  5. Driver contract + mobility clause

    Express mobility clause required. Flat-rate posting allowances (stay allowance) to be formalised.

Maximum SCC penalties

Cumulative sanctions SCC + Highway Code + European regulation. Non-compliant tachograph: level 3 per vehicle. Driving-time overrun: immediate roadside fines + possible criminal sanction.
